Acceptance of Terms

• By using our services, you confirm that you agree to be bound by these Terms and Conditions.
• These Terms and Conditions form a legally binding agreement between you and CYBERSIGHT.

Eligibility & Age Restrictions

• By purchasing our products or utilizing the CYBERSIGHT App and services, you represent and warrant that you are at least 16 years of age (or the minimum legal age required in your jurisdiction to consent to the processing of personal and health-related data).
• If you are under the legal age of majority but at least 13 years old, you may only use our device and services under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms of Service. CYBERSIGHT does not knowingly collect or solicit data from anyone under the age of 13. If we learn that we have collected personal data from a child under 13 without verification of parental consent, we will delete that information as quickly as possible.

Services Provided

• CYBERSIGHT provides intelligent wearable solutions and digital tools, powered by advanced technologies such as: “Real-time HUD display,” “AI-driven performance coaching,” “Sensor integration and data visualization,” etc.
• All features are subject to availability and may be updated, modified, or discontinued at our sole discretion.

Software, Firmware Updates (OTA) & App Availability

• CYBERSIGHT may from time to time provide firmware updates, bug fixes, or App optimizations. All software, firmware, and cloud-connected features are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• We do not guarantee that the software functions or data synchronization will be uninterrupted, secure, or error-free. CYBERSIGHT shall not be liable for any training data loss, athletic metric syncing failures, or temporary device unavailability caused by system updates, server maintenance, or wireless connection drops.

Third-Party Integrations & Device Compatibility

• CYBERSIGHT HUD Glasses are designed to interact with various third-party hardware devices, sensors (including but not limited to ANT+ and Bluetooth smart sensors, power meters, heart rate monitors), and external software platforms (such as Strava, Garmin Connect, Apple Health, etc.).
• You acknowledge and agree that CYBERSIGHT does not control, and assumes no responsibility for, the service stability, privacy practices, data synchronization accuracy, or ongoing API compatibility of these third-party platforms or hardware manufacturers. Any changes, restrictions, or discontinuance of support by third-party ecosystems do not constitute a defect in CYBERSIGHT hardware and shall not entitle the user to a refund or compensation.

User Responsibilities

• You agree to use our services strictly for lawful, personal, and non-commercial purposes.
• You are responsible for ensuring that your use of the platform complies with all applicable laws and regulations.
• Any unauthorized use—including but not limited to reverse engineering, resale, modification, or tampering with CYBERSIGHT systems—is strictly prohibited.

Intellectual Property & Restrictions on Use

• All content, hardware designs, user interface elements, and software algorithms provided by CYBERSIGHT are the intellectual property of SINGAPORE CYBERSIGHT TECHNOLOGY PTE. LTD. and its licensed affiliates. You may not copy, reproduce, distribute, or commercially exploit any part of our platform without prior written consent.
• All intellectual property rights in the CYBERSIGHT HUD Glasses, including but not limited to the hardware design, optical projection systems, firmware, proprietary data overlays, App user interfaces, trade names, logos, and software algorithms, are the exclusive property of SINGAPORE CYBERSIGHT TECHNOLOGY PTE. LTD. and its licensed affiliates.
• You expressly agree that you shall not, and shall not permit or encourage any third party to: (i) reverse engineer, decompile, disassemble, or attempt to extract the source code or hardware schematics of the device or its firmware; (ii) modify, adapt, tamper with, or create derivative works based on the HUD graphic interfaces or App; (iii) bypass, modify, or defeat any security or digital rights management measures implemented in the product.

Privacy and Data Use

• Your privacy is important to us. By using CYBERSIGHT, you acknowledge and agree to our Privacy Policy.
• Data collected through your usage may be used to enhance system performance, improve product features, and personalize your experience.
• Personally identifiable information will never be shared without your explicit consent, unless required by law.

Sport Safety & Distraction Warning

• CYBERSIGHT HUD Glasses are designed to provide supplemental sports performance data (including but not limited to speed, cadence, heart rate, and navigation tracking) for situational awareness only. They do NOT replace the user’s primary duty to monitor road conditions and exercise personal judgment. Operating bicycles, running, or engaging in any outdoor activities while distracted can cause serious injury, property damage, or death.
• CYBERSIGHT (including its affiliates, directors, and developers) shall not be liable for any personal injury, property damage, traffic accidents, or legal disputes resulting from the use or misuse of our products, reliance on any displayed data, or the temporary unavailability of data displays. You acknowledge and agree that you use this device at your own sole risk.

Limitation of Liability

• CYBERSIGHT is provided “as is,” without warranties of any kind.
• We are not liable for any direct, indirect, incidental, or consequential losses resulting from the use of our services.
• While we strive for high accuracy, CYBERSIGHT’s data and AI outputs are not guaranteed to be error-free or suitable for all purposes.

Termination

• We reserve the right to suspend or terminate your access to our services if you breach these Terms and Conditions.
• Upon termination, your rights to use the platform will cease immediately without prior notice.

Changes to Terms

• We may revise these Terms and Conditions periodically. Any updates will be published on this page with the effective date.
• Continued use of our services after such changes constitutes your acceptance of the revised terms.

Governing Law & Jurisdiction

• Governing Law for Transactions: These Terms of Service and any separate agreements whereby we provide you Shipping, Refund, or Billing Services shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes relating to transactions shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
• Governing Law for Intellectual Property: Any matters or disputes arising out of or related to the Intellectual Property, firmware, or App services of CYBERSIGHT shall be governed by the laws of Singapore.
